About the Authors:

Kari Dunn Buron, M.S., is the coordinator of an ASD certificate program for educators at Hamline University in St. Paul. MN. She received her Master of Science degree in behavior disorders and learning disorders from Illinois State University in 1980. She recently retired from K-12 special education after more than 30 years. Kari is one of the founding members of the MN Autism Network, a statewide group of Autism Resource Specialists, and a past president of the Autism Society of Minnesota. She has spent 17 years working with the Autistic Society of Trinidad and Tobago, where she travels annually to volunteer in homes and schools. In 1995, Kari developed Camp Discovery, a summer camp for youth with Asperger Syndrome. In 2003, she received a fellowship that allowed her to study social cognition and ASD from an international perspective.

Brenda Smith Myles Ph.D., a consultant with the Ziggurat Group and the Education and Treatment Services Project for Military Dependent Children with Autism, is the recipient of the Autism Society of America’s Outstanding Professional Award, the Princeton Fellowship Award, and the Council for Exceptional Children, Division on Developmental Disabilities Burton Blatt Humanitarian Award. Brenda has made over 500 presentations all over the world and written more than 150 articles and books on ASD including Asperger Syndrome and Difficult Moments: Practical Solutions for Tantrums, Rage, and Meltdowns (with Southwick) and The Hidden Curriculum: Practical Solutions for Understanding Unstated rules in Social Situations. In addition, she served as the co-chair of the National ASD Teacher Standards Committee and was on the National Institute of Mental Health’s Interagency Autism Coordinating Committee’s Strategic Planning Consortium. Myles is also on the executive boards of several organizations, including the Organization for Autism Research and ASTEP – Asperger Syndrome Training and Education Program. In addition, in the latest survey conducted by the University of Texas, she was acknowledged as the second most productive applied researcher in ASD in the world.

A Post-transplant Patient Speaks Out: “We Have an Organ-Donor Crisis and Need an Additional Policy!”

According to post-transplant patient David Courtney, America’s present system of organ donation that relies primarily on “altruism” is failing miserably in meeting the demand for organs because the waiting list keeps increasing rapidly, now nearing 113,000 according to the United Network for Organ Sharing the Federally contracted operator of the US Organ Procurement and Transplantation Network. According to the Los Angeles Times, on average, one person that has been listed for transplant dies every 52 minutes.    

He is the President of the Presumed Consent Foundation, Inc, and a member of the FAIR Foundation’s Board of Directors whose 27 transplant surgeons, medical directors and patient advocates support of the implementation of Presumed Consent policy.

Courtney has intimate knowledge regarding the long wait for transplant. His life was close to ending after many years waiting for a double lung transplant.

“Although my life has been saved,” Courtney states, I continue to fight for change from our present policies because so many others are needlessly dying; indeed, thousands of those lives can be saved.”

Courtney recommends a new organ-donor policy called “Presumed Consent” which would mandate that all citizens are organ-donors; however each citizen retains the right of free choice—they can opt out of the system at any time.

“Making a choice,” Courtney clarifies, “remains the most important part of this policy as everyone is entitled to have their choice honored. This policy is presently in effect in 27 countries. It is the fastest and least expensive way to lessen the shortage of organs for transplantation.”

Courtney states, “Studies by the Association of Organ Procurement Organizations and its members have shown that when faced with a decision at the time of a tragic event, many people do not consent to donation of their loved one’s organs or tissue, simply because they don’t know their loved one’s choice. As a result our current ‘opt-in’ system based on altruism is not meeting the demand for organs.

“Even with our state and federal governments having spent billions of dollars on educating our public on the need for donation, we still have the crisis of a death every 52 minutes,” adds Courtney.

Courtney has clarified in presentations throughout the USA to Patient and Civic Groups, the United Network for Organ Sharing’s Ethics Committee and the US Department of Health and Human Service’s Advisory Committee on Organ Transplantation, as well as many state and federal legislators and committees that Presumed Consent Policy in the US should be implemented with integral capabilities as championed by the Spanish Model of Presumed Consent: Notification, education, awareness, a central registry, program management, and legal protection for providers and oversight.

Courtney summarizes his position, “Yes, my life was saved by our present policy but thousands of others are dying and we must fight to help them with the implementation of Presumed Consent policy which will provide many more organs for life-saving transplant.”

Some Constitutive Federal Laws for the Disabled

The United States Federal Government has provided enough laws that ensure equal opportunity for people with disabilities. These provisions are waged in order to strike the imbalance growing out from the difference in physical and psychological attributes among people.

These laws are all aimed at approximating equality for all regardless of their personal circumstances and physical defects. This is not only mandated by law but also developed as an obligation.

The Federal Law has provided constitutive rules addressing this concern. In fact, there are many federally mandated laws for the disabled. To name a few of these pertinent laws would be illuminating, thus:

Federal Disability Laws

•    The Social Security Disability Insurance (SSDI) and Supplemental Security Income (SSI) disability program

It is the largest of several Federal programs managed by the Social Security Administration that assists people with disabilities. SSDI pays benefits to people who are unable to work because of a disability. On the other hand, SSI pays benefits to individuals who have both limited income and resources.  It is a provision that is primarily based on financial need.

•    Americans with Disabilities Act of 1990 42 U.S.C. §§ 12101 et seq.

It is a federal law that provides civil rights protection to persons with disabilities in the area of employment, public accommodations, and services made available by state and local governments, transportation and telecommunications. 

The ADA prohibits discrimination based on disability by calling for the removal of communication and architectural barriers. 

•    Fair Housing Amendments Act of 1988 42 U.S.C. §§ 3601 et seq.

A federal law that prohibits housing discrimination based on race, color, religion, sex, disability, familial status, and national origin. It covers private housing, housing that receives Federal financial assistance, and State and local government housing. 

In brief, its mandate against unlawful discrimination covered the following activities: any aspect of selling or renting housing, including financing, zoning practices, new construction design, and advertising.

•    The Rehabilitation Act of 1973 ,as amended (Section 501 29 U.S.C. § 791, Section 503 29 U.S.C. § 793, Section 504 29 U.S.C. § 794 and Section 508 29 U.S.C. § 794d)

It is a law that prohibits discrimination based on disability in programs conducted by Federal agencies; in programs, which received Federal financial assistance; in Federal employment; and in the employment practices of Federal contractors. 

It focuses on requiring non-discriminatory actuations in federal employment and guaranteeing affirmative actions for the disabled.

•    Individuals with Disabilities Education Act 20 U.S.C. §§ 1400 et seq.

It is a federal law that requires public schools to make available to all eligible and disabled children (age three – twenty one) a special education and related services including a free appropriate public education in the least restrictive environment appropriate to their individual needs.

•    Telecommunications Act of 1996 47 U.S.C. §§ 255, 251(a)(2)

It is the law that ensures people with disabilities easy access to a broad range of telecommunication products and services. Manufacturers of telecommunication equipment and providers of telecommunication services are required to provide accessibility of equipment and services for use of persons with disabilities.

•    Voting Accessibility for the Elderly and Handicapped Act of 1984
42 U.S.C. §§ 1973ee et seq.

Physical accessibility of polling places across the US (for federal Elections), availability of registration and voting aids for disabled and elderly voters are partly mandated by these federal laws all for the benefit of the disabled and elderly sector.
